Terms and conditions

This page contains Beatrice Contrini’s (the Photographer) Terms and Conditions. The acceptance of the booking is based on agreement by the client of the terms and conditions stated herein.

BOOKING

  1. The retainer must be paid in full at the time of booking. The retainer secures the time and services of the Photographer for the sitting and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. Sittings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time. Following payment of the retainer balance of any fees due is to be paid on, or before the date of the sitting. No photographs will be delivered until all payments due have been paid in full. Payment for albums and wall art is to be made when they are ordered

    PHOTO SESSION

  2. The Client understands and accepts that the Photographic coverage will be as the Photographer’s professional expertise determines.  Special requests are not binding instructions although every effort is made to comply with the Clients wishes.

  3. The Photographer shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. The Photographers’ judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.

  4. It is client’s responsibility to take care of the children. The Photographer will not accept any responsibility due to any accident to children or damage to public or private properties during the photo shooting or consultation session.

  5. It is understood that no other photographer, amateur or professional, shall be allowed to photograph at the venue (wedding, portrait, family photography , etc.) while the Photographer is working, and that any breach of this agreement will constitute a reason for non-completion of the job with no liability to the Photographer and loss of initial deposit by the client. 

  6.  In the unlikely event of total photographic failure or cancellation of the contract by the Photographer, liability shall be limited to a full refund of all monies paid. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.

    Product Delivery

  7. Images deliverable in High-Resolution (or known as High-Res) are 300DPI with 3000 Pixels in the longest edge.

  8. All photographic materials, such as original negatives, photos, or slides, shall be the exclusive property of the Photographer. The Photographer shall own the copyright in all images created and may use the work for samples, contests, exhibition, advertising and self-promotion, unless Clients expressly decline, providing that the images are used lawfully and without damage to the clients . Usage outside the bounds of this agreement will require the Client’s consent. 

  9. The Client shall obtain digital pictures and prints for personal use only and shall not sell the photos. Copies of the pictures can be given to family members; these have the same restrictions as the photographer's client.

  10. This clause applies to all social media, including Facebook and blogs. When published online it is required that citation of photographer be made. The client agrees that they will under no circumstances alter any photographs that are placed in public on the internet. The client agrees to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be cropped (with the exception of the forced cropping for Facebook’s Timeline), altered in color, or edited in any way.

  11. Clients affirm legal guardianship of children under the age of 18 and consent to them appearing in photographs. In undertaking services with the Photographer the same release applies to any other person who appears in the images.

  12. The Photographer keeps client files for up to 3 months after the photography session, and is not liable for any claims after this period. All client files will be deleted and backups will be purged after this period.

  13. Client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s experience and artistic view. Any extra edits requested by the client will incur additional cost if accepted by the Photographer. Extra image adjustments include: change the size of the body or parts of the body, replace parts of the body from another image, change the colour of parts of the body, extra skin retouch, replace or swap background. It is also understood that the Photographer is not responsible to fix hair or skin, or makeup problems. Retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost and free for albums or wall art purchase.

  14. The Photographer will provide a pleasing colour balance, but cannot guarantee exact colour matching. In the case of part mono/part colour images, the colours used will be subject to the photographer’s artistic interpretation and will be deemed to be correct.

    COvid-19 situation

The maximum number of participants at one point should is at a maximum of 5 if different household and 10 if same household. The Photographer will maintain a 1 to 2 meters distance at all times. For outdoor photo shoot, masks must be on when moving from point to point.

To protect the safety and health of the photographer and the community, I would ask that you refrain from making an appointment should you:

  • Suffering from symptoms such as fever, cough, runny nose, shortness of breath etc.

  • Currently on Medical Leave

  • Travelled or returned from overseas in the past 14 days

  • Come into contact with anyone who suspected to be infected with Covid-19 virus
